Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of mentalium.tech (the “Site”) and the AI automation and messaging-agent services offered by Mentalium, based in Amman, Jordan (“Mentalium,” “we,” “us,” or “our”, collectively the “Services”). By accessing the Site or engaging our Services, you agree to these Terms. If you do not agree, do not use the Site or the Services.
Who These Terms Apply To
These Terms apply to visitors to the Site and to businesses that inquire about or purchase Mentalium’s Services. Paid engagements may be governed by a separate signed proposal, order form, or service agreement; where such an agreement conflicts with these Terms, the signed agreement controls.
Use of the Site
You agree to:
- Use the Site only for lawful purposes and in accordance with these Terms
- Not misuse, disrupt, probe, or attempt to gain unauthorized access to the Site or its underlying systems
- Not submit false, misleading, or fraudulent information through our forms
- Not scrape, copy, or republish Site content without our prior written consent
Our Services
Mentalium designs and operates AI automation tools and messaging agents, including agents integrated with official WhatsApp Business API, Instagram, and Facebook Messenger APIs, for business clients. Specific scope, deliverables, pricing, and timelines for a paid engagement are set out in the applicable proposal or service agreement with that client, not in these Terms.
No guaranteed outcomes. While we aim for high-quality automation, we do not guarantee specific business results (such as sales volume, response times, or conversion rates), as these depend on factors outside our control, including third-party platform behavior and client-provided content.
Third-party platforms. Our Services rely on third-party platforms (including Meta’s WhatsApp, Instagram, and Messenger APIs, and hosting and email infrastructure such as Cloudflare and Resend). We are not responsible for outages, policy changes, or restrictions imposed by these third parties, and your use of those platforms remains subject to their own terms.
Intellectual Property
All content on the Site — including text, graphics, logos, and code — is owned by or licensed to Mentalium and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission. Custom automation deliverables built for a client are governed by the intellectual property terms in that client’s signed agreement.
Confidentiality
Information you share with us through inquiries or during a client engagement will be treated as confidential and used only to evaluate or deliver the requested Services, consistent with our Privacy Policy.
Disclaimers
The Site and any information on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
Limitation of Liability
To the maximum extent permitted by law, Mentalium and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from your use of the Site or the Services. Our total liability for any claim arising from the Site or a paid engagement will not exceed the amount you paid to us for the Services giving rise to the claim in the preceding three months, except where a signed service agreement states otherwise.
Indemnification
You agree to indemnify and hold Mentalium harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Site or breach of these Terms.
Termination
We may suspend or terminate your access to the Site at any time if we reasonably believe you have violated these Terms. Termination of a paid engagement is governed by the applicable service agreement.
Governing Law
These Terms are governed by the laws of the Hashemite Kingdom of Jordan, without regard to conflict-of-law principles, and any dispute not resolved informally will be subject to the exclusive jurisdiction of the courts of Amman, Jordan — unless a signed service agreement with a client specifies a different governing law or venue for that engagement.
Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the Site or Services after changes take effect constitutes acceptance of the revised Terms.
